Payment Schedule
The artwork fee, shipping and handling fees, and all additional Client/Artist agreed out-of-pocket fees relating to the client project, plus Indiana state sales tax (for Indiana residents only) are due at the time of order placement. Custom original artwork usually ships within two to three weeks of order placement. Giclée prints on canvas usually ship within three to four weeks of order placement. Clients will be contacted, if artwork requires an extended shipping date beyond the two to four week period, due to current order volume. Should your order need to arrive by a certain date, you may contact us for "rush" service, for an additional rush fee of $75.00 and your order will be moved to the front of the line. We would also recommend that you request the "Next Day" shipping option and pay the additional shipping fee.
Sales Tax
The Client shall be responsible for the payment of sales tax, if any such tax is due.
Default in Payment
The Client shall assume responsibility for all collection of legal fees necessitated by default in payment.
Reservation of Rights
All rights are retained by the Artist, including any electronic rights of usage and including, but not limited to, all rights in sketches, comps, or other preliminary materials. Any use additional to that expressly granted in writing by the Artist requires arrangement for payment of a separate fee. The Artist retains all rights of copyright. Sale of original art does not include transfer of copyright.
Expenses
The Client shall reimburse the Artist for all expenses arising from the Client project/assignment.
Estimates for Custom Artwork
The initial fees and expenses shown are minimum estimates only. Final fees and expenses shall be shown when invoice is rendered. The Client’s approval shall be obtained for any increases in fees or expenses that exceed the original estimate by 10% or more.
Alterations
Alteration to artwork shall not be made without consulting the initial Artist, and the Artist shall be allowed the first option to make alterations when possible. After acceptance of artwork, if alterations are required, a payment shall be charged over the original amount.
Revisions
Revisions not due to the fault of the Artist shall be billed separately.
Credit Lines
On any contribution for magazine or book use, the Artist shall receive name credit in print. If name credit is to be given with other types of use, it must be as specified here: electronic rights of usage. (See "Reservation of Rights" above.) The artist shall receive copyright notice adjacent to the work in the form:

Unauthorized Use
The Client will indemnify the Artist against all claims and expenses, including reasonable attorney’s fees, arising from uses for which no release was requested in writing or for uses exceeding the authority granted by a release.
Return/Refund Policies
For Giclée art prints on canvas arriving with damage due to shipping
mishandling or other obvious surface flaws, we will replace the art
print or provide web store credit for the amount of the artwork. For
all custom artwork where Client approved proofs or sketches have been
supplied prior to original artwork shipment, no returns or refunds are
available, unless damage is present due to shipping mishandling. The
Client is responsible for all shipping fees. No shipping fees will be
refunded.
Cancellation Policy
In the event of cancellation or breach by the Client, the Artist shall
retain all rights of copyright and ownership of the original artwork,
including sketches and any other preliminary materials. For all custom
artwork projects, the Client shall pay the Artist according to the
following schedule: 50% of original fee if cancelled after preliminary
sketches are completed, or 100% if cancelled after completion of
finished art. If projects are cancelled during the design phase, the
Client will pay a prorated fee to compensate for the Artist’s time,
plus all out-of-pocket and material costs related to the Client’s
project. Clients are responsible for payment of all costs related to
their project.
Acceptance of Terms
The signature of the client or clicking the “acceptance” box shall
evidence acceptance of these terms. Any purchases made from the Terhune
Design website/e-store signify agreement to all terms.
